2008年,在自治區(qū)黨委和自治區(qū)人民政府的正確領(lǐng)導(dǎo)下，自治區(qū)知識(shí)產(chǎn)權(quán)保護(hù)工作堅(jiān)持以鄧小平理論和“三個(gè)代表”重要思想為指導(dǎo)，全面落實(shí)科學(xué)發(fā)展觀，大力實(shí)施國(guó)家知識(shí)產(chǎn)權(quán)戰(zhàn)略，取得了顯著成績(jī)。
一、知識(shí)產(chǎn)權(quán)審批登記
2008年，全區(qū)全年專利申請(qǐng)2412件，發(fā)明申請(qǐng)482件，實(shí)用新型申請(qǐng)1408件，外觀設(shè)計(jì)申請(qǐng)522件，非職務(wù)發(fā)明申請(qǐng)1621件，職務(wù)發(fā)明申請(qǐng)791件；全區(qū)專利授權(quán)1493件，發(fā)明授權(quán)82件，實(shí)用新型授權(quán)1100件，外觀設(shè)計(jì)授權(quán)311件，非職務(wù)發(fā)明授權(quán)993件，職務(wù)發(fā)明授權(quán)500件。
新注冊(cè)商標(biāo)2725件，新認(rèn)定著名商標(biāo)46件，新疆“天彩”被認(rèn)定為中國(guó)馳名商標(biāo)。
作品登記330件，同比增長(zhǎng)6.5%；版權(quán)合同備案34件。認(rèn)定軟件企業(yè)5家。
植物新品種權(quán)申請(qǐng)14件。
二、知識(shí)產(chǎn)權(quán)執(zhí)法保護(hù)
2008年，全區(qū)出動(dòng)專利執(zhí)法人員965人（次），檢查商業(yè)場(chǎng)所532次，檢查商品19.98萬(wàn)件，受理案件63件，結(jié)案49件，查處假冒他人專利案件50起，查處冒充專利案件1起，接受其他部門移交案件1件，區(qū)內(nèi)協(xié)作執(zhí)法50次，區(qū)外協(xié)作執(zhí)法1次。2008年6～7月，自治區(qū)人大與知識(shí)產(chǎn)權(quán)局聯(lián)合對(duì)5地州市貫徹執(zhí)行《專利法》和《自治區(qū)專利保護(hù)條例》情況進(jìn)行了專項(xiàng)檢查。
全區(qū)查處商標(biāo)違法案件1044件，案值1121.36萬(wàn)元，罰款349.92萬(wàn)元，收繳和消除商標(biāo)標(biāo)識(shí)8247件，沒收、銷毀侵權(quán)商品96695件。
全區(qū)版權(quán)管理部門出動(dòng)執(zhí)法人員3.6萬(wàn)人（次），出動(dòng)車輛7800輛（次），檢查出版物市場(chǎng)3832個(gè)（次），檢查店檔攤點(diǎn)8306個(gè)（次），檢查印刷復(fù)制企業(yè)2470家，收繳非法出版物877,193冊(cè)（張），取締店檔攤點(diǎn)47個(gè)、取締企業(yè)10家。指導(dǎo)喀什等6地州市近400家網(wǎng)吧與微軟公司簽訂了授權(quán)許可合同。對(duì)先進(jìn)單位進(jìn)行表彰。對(duì)喀什等地州政府及勘察設(shè)計(jì)企業(yè)CAD軟件正版化工作進(jìn)行了檢查驗(yàn)收。2008年4月20日，舉辦了2008年全國(guó)集中銷毀侵權(quán)盜版及非法出版物新疆分會(huì)場(chǎng)銷毀活動(dòng)。銷毀各類非法出版物386,674冊(cè)（張）、非法音像制品等289,046件。
海關(guān)查處案件59起，查獲侵權(quán)商品30余種，案值約140萬(wàn)元。
農(nóng)業(yè)、林業(yè)管理部門出動(dòng)執(zhí)法人員56人（次），車輛37車（次），檢查林業(yè)苗圃800余個(gè)，抽查林業(yè)苗木品種6個(gè)，苗木16批（次）、約140萬(wàn)株，樣株948個(gè)。檢查林木加工企業(yè)10家。
三、知識(shí)產(chǎn)權(quán)司法保護(hù)
2008年，公安機(jī)關(guān)受理案件15起，立案7起，案值440萬(wàn)元。破案5起，抓獲犯罪嫌疑人14名。
法院受理案件252件，其中一審案件223件，二審案件29件。專利案件41件，商標(biāo)案件93件，著作權(quán)案件75件，技術(shù)合同案件35件，其他案件8件。全年結(jié)案245件，其中一審結(jié)案216件，二審結(jié)案29件。
Summary of Intellectual Property Protection in Xinjiang Uygur Autonomous Region in 2008
In 2008, under the right leadership of Party Committee and People’ s Government of Autonomous Region, the intellectual property rights protection work achieved remarkable results under the guidance of the Deng Xiaoping Theory and “Three Represents” and with the thorough implementation of the scientific outlook on development and the national property rights strategy.
I. IPR Approval and Registration
There were 2,412 patent applications, among them 482 applications were for invention patent, 1,408 applications for utility model patent, 522 applications for design patent, 1,621 applications for non-service invention patent, 791 applications for service invention patent. 1,493 patents of the region were granted, among them 82 pieces were for invention patent, 1,100 pieces for utility model patent, 311 pieces for design patent, 993 pieces for non-service invention patent, and 500 pieces for service invention patent.
There were 2,725 registered trademarks, newly found 46 well-known trademarks, Xinjiang “Tian Cai” had been identified as a well-known trademark in China.
330 works were registered in the region with an increase of 6.5%; 34 copyright contracts were recorded, and five software companies were identified.
14 new plant varieties were applied.
II. IPR Enforcement and Protection
Patent Law Enforcement Departments in whole region dispatched 965 officials, investigated 532 commercial premises and 199,800 products, processed 63 patent infringement cases, among them 49 closed, investigated and dealt with 50 cases of bogus patents, investigated 1 counterfeit patent case, accepted 1 case transferred from other department, collaborated 50 times within region, and 1 time across regions in law enforcement action. From June to July, People’s Congress of Autonomous Region and Intellectual Property Rights Administration worked together to initiate special check on the executive condition of “Patent Law” and “Patent Protection Regulations of Autonomous Region” in five administrative districts.
In 2008, Autonomous Region investigated and treated 1,044 illegal cases of trademarks in total, valued 11.2 million yuan, imposed a fine of 3,499,200 yuan, collected and eliminated 8,247 trademarks, confiscated and destroyed 96,695 infringing goods.
Copyright Management Department of Autonomous Region sent out a total of 36,000 law enforcement officials; 7,800 vehicles; checked 3,832 publications markets, 8,306 shops and stalls (sub), 2,470 printing copy enterprises; confiscated 877,193 copies of illegal publications ( pieces ), banned 47 shops and stalls, banned 10 enterprises, guided 400 internet bars in Kashi, etc., guide around 400 cyberbars in 6 districts such as Kashi to sign authorized permission contracts with Microsoft, commended advanced units, checked and accepted the genuine software implementation work of the state government of Kashi as well as genuine software of CAD in survey and design enterprise. On April 20th, National Destruction Activity of Piracy and Illegal Publications of 2008 was held in Urumqi city in Xinjiang venue. 386,674 copies of various illegal publications and 289,046 illegal audio-visual products were destroyed.
Customs investigated 59 cases, tracked down more than 30 species infringing goods worth 1.4 million yuan.
Agricultural Management Department and Forestry Management Department deployed 56 (times) law enforcement officers in total, 37 law enforcement vehicles (times), checked more than 800 forestry nurseries, sampled 6 varieties of forestry seedlings, 16 batches of seedlings (times), about 1.4 million strains, and 948 sample strains, and examined 10 timber processing enterprises.
III. IPR Judicial Protection
The public security organs handled a total of 15 cases, registered 7 cases, valued 4.40 million, solved 5 cases, and arrested 14 suspects.
Courts handled a total of 252 cases, 223 cases of the first instance and 29 cases of second instance; 41 cases of patent, 93 cases of trademark, 75 cases of copyright, 35 cases of technology contract, other eight cases. 245 cases were closed in whole year, among them, 216 cases were closed in the first instance, 29 cases in the second instance.
