2008年，為全面貫徹實(shí)施知識(shí)產(chǎn)權(quán)戰(zhàn)略，貴州省人民政府從7個(gè)方面加強(qiáng)了知識(shí)產(chǎn)權(quán)工作。
一、推進(jìn)《國(guó)家知識(shí)產(chǎn)權(quán)戰(zhàn)略綱要》和《貴州省知識(shí)產(chǎn)權(quán)戰(zhàn)略綱要》的貫徹實(shí)施
2008年，貴州省制定了《<貴州省知識(shí)產(chǎn)權(quán)戰(zhàn)略綱要>2008年度推進(jìn)計(jì)劃》；建立了實(shí)施知識(shí)產(chǎn)權(quán)戰(zhàn)略的考核評(píng)價(jià)體系，落實(shí)了各市、州、地政府（行署）實(shí)施知識(shí)產(chǎn)權(quán)戰(zhàn)略的目標(biāo)責(zé)任制；省政府與國(guó)家知識(shí)產(chǎn)權(quán)局建立了合作會(huì)商機(jī)制，確立了工作任務(wù);建立了貴州省知識(shí)產(chǎn)權(quán)戰(zhàn)略實(shí)施工作聯(lián)席會(huì)議制度。
二、圍繞重點(diǎn)領(lǐng)域和產(chǎn)業(yè)加強(qiáng)調(diào)研工作，推進(jìn)知識(shí)產(chǎn)權(quán)制度建設(shè)
2008年，貴州省完善了《貴州省傳統(tǒng)知識(shí)的知識(shí)產(chǎn)權(quán)保護(hù)條例》草案；開(kāi)展全省農(nóng)特產(chǎn)品地理標(biāo)志調(diào)研，提出了《貴州省農(nóng)特產(chǎn)品地理標(biāo)志保護(hù)建議目錄》，起草了《關(guān)于加強(qiáng)農(nóng)特產(chǎn)品地理標(biāo)志工作，大力促進(jìn)我省農(nóng)特經(jīng)濟(jì)發(fā)展的意見(jiàn)》報(bào)請(qǐng)省政府頒布實(shí)施；出臺(tái)了《關(guān)于促進(jìn)科技創(chuàng)新中的知識(shí)產(chǎn)權(quán)創(chuàng)造和運(yùn)用的若干意見(jiàn)》；制定了《貴州省高新技術(shù)產(chǎn)業(yè)知識(shí)產(chǎn)權(quán)工作指導(dǎo)意見(jiàn)》和《關(guān)于加強(qiáng)旅游產(chǎn)業(yè)知識(shí)產(chǎn)權(quán)工作的意見(jiàn)》。
三、強(qiáng)化知識(shí)產(chǎn)權(quán)保護(hù)，進(jìn)一步整頓和規(guī)范市場(chǎng)秩序
省知識(shí)產(chǎn)權(quán)部門組織開(kāi)展了“雷雨”、“天網(wǎng)”知識(shí)產(chǎn)權(quán)執(zhí)法專項(xiàng)行動(dòng)；工商部門開(kāi)展了奧林匹克標(biāo)志宣傳及奧林匹克標(biāo)志保護(hù)專項(xiàng)行動(dòng)；版權(quán)部門開(kāi)展了“治理非法預(yù)裝計(jì)算機(jī)軟件專項(xiàng)行動(dòng)”；海關(guān)加強(qiáng)一線緝查力度保護(hù)省名牌商標(biāo)；公安機(jī)關(guān)開(kāi)展了打擊制售假冒國(guó)酒茅臺(tái)等白酒產(chǎn)品的“國(guó)酒二號(hào)”專項(xiàng)行動(dòng)。
四、深入開(kāi)展企事業(yè)單位和區(qū)域知識(shí)產(chǎn)權(quán)工作，提升市場(chǎng)主體運(yùn)用知識(shí)產(chǎn)權(quán)制度的能力和水平
2008年，貴州省推進(jìn)第二輪全省企事業(yè)單位知識(shí)產(chǎn)權(quán)試點(diǎn)示范工作；充分運(yùn)用政府資金的引導(dǎo)作用，大力推進(jìn)重點(diǎn)產(chǎn)業(yè)實(shí)施知識(shí)產(chǎn)權(quán)戰(zhàn)略；貴陽(yáng)市和遵義市穩(wěn)步推進(jìn)國(guó)家知識(shí)產(chǎn)權(quán)示范城市創(chuàng)建和知識(shí)產(chǎn)權(quán)試點(diǎn)城市工作。
五、深入開(kāi)展宣傳培訓(xùn)和人才培養(yǎng)工作，提高全社會(huì)知識(shí)產(chǎn)權(quán)意識(shí)
2008年，貴州省創(chuàng)新形式開(kāi)展“4.26”世界知識(shí)產(chǎn)權(quán)日宣傳周活動(dòng)；繼續(xù)在貴州日?qǐng)?bào)開(kāi)辟專欄；啟動(dòng)貴州省“十百千人才培養(yǎng)工程”，制定了《貴州省知識(shí)產(chǎn)權(quán)人才隊(duì)伍建設(shè)規(guī)劃（2008-2015年）》及《貴州省實(shí)施“十百千”知識(shí)產(chǎn)權(quán)人才培養(yǎng)工程方案》；深入開(kāi)展知識(shí)產(chǎn)權(quán)培訓(xùn)，共舉辦各類知識(shí)產(chǎn)權(quán)培訓(xùn)、講座108期。
六、加強(qiáng)知識(shí)產(chǎn)權(quán)信息化建設(shè)，強(qiáng)化公共服務(wù)職能
貴州省知識(shí)產(chǎn)權(quán)門戶網(wǎng)站全面改版，建立了集“七國(guó)兩組織”中外專利數(shù)據(jù)庫(kù)、馳名商標(biāo)、著名商標(biāo)、地理標(biāo)志、植物新品種等于一體的貴州省知識(shí)產(chǎn)權(quán)信息平臺(tái)。組織開(kāi)展了貴州省第二屆專利技術(shù)展示交易周活動(dòng)。
七、充分發(fā)揮知識(shí)產(chǎn)權(quán)專項(xiàng)資金的引導(dǎo)扶持作用，促進(jìn)知識(shí)產(chǎn)權(quán)創(chuàng)造和實(shí)施
省級(jí)知識(shí)產(chǎn)權(quán)專項(xiàng)資金資助知識(shí)產(chǎn)權(quán)申請(qǐng)1345件187.62萬(wàn)元。其中專利1301件，植物新品種44件，地理標(biāo)志3件。七個(gè)市、州、地區(qū)設(shè)立了專項(xiàng)資金，對(duì)轄區(qū)內(nèi)的專利申請(qǐng)給予資助。
一年來(lái)，貴州省知識(shí)產(chǎn)權(quán)創(chuàng)造和保護(hù)成效顯著：
專利：申請(qǐng)2943件，同比增長(zhǎng)6.7%；授權(quán)1728件，與上年持平。發(fā)明專利873件,與上年持平；實(shí)用新型專利1403件,同比增長(zhǎng)9.1%；職務(wù)發(fā)明1783件,同比增長(zhǎng)16.1%。
商標(biāo)：申請(qǐng)3278件，注冊(cè)1590件，同比增長(zhǎng)10%；其中農(nóng)產(chǎn)品商標(biāo)714件，同比增長(zhǎng)12.3%。新增6個(gè)中國(guó)馳名商標(biāo)。開(kāi)展了2008年度“貴州省著名商標(biāo)”的認(rèn)定工作，新增103件“貴州省著名商標(biāo)”。
版權(quán)：登記67件，同比增長(zhǎng)76%。
其他知識(shí)產(chǎn)權(quán)： 26個(gè)品種申報(bào)植物新品種權(quán)，8個(gè)獲授權(quán)。大方天麻、頂壇花椒、連環(huán)砂仁、玉屏簫笛獲得地理標(biāo)志產(chǎn)品稱號(hào)。
打擊侵犯知識(shí)產(chǎn)權(quán)犯罪活動(dòng)：建立了“國(guó)酒茅臺(tái)等貴州白酒知識(shí)產(chǎn)權(quán)刑事執(zhí)法保護(hù)聯(lián)席會(huì)議制度”，建立了“重點(diǎn)聯(lián)系企業(yè)知識(shí)產(chǎn)權(quán)數(shù)據(jù)庫(kù)”和“侵犯知識(shí)產(chǎn)權(quán)犯罪嫌疑人數(shù)據(jù)庫(kù)”，制定了《貴州省公安機(jī)關(guān)保護(hù)知識(shí)產(chǎn)權(quán)警企協(xié)作聯(lián)系機(jī)制》。開(kāi)展了“國(guó)酒二號(hào)”專項(xiàng)行動(dòng)，共銷毀假茅臺(tái)酒13,000瓶、侵權(quán)茅臺(tái)酒10,000瓶、商標(biāo)等假冒侵權(quán)包裝物6000余件（套）及相關(guān)生產(chǎn)工具等。
知識(shí)產(chǎn)權(quán)司法保護(hù)：全省法院受理知識(shí)產(chǎn)權(quán)一審案件157件，結(jié)案139件。
Summary of Guizhou Provincial Intellectual Property Protection in 2008
In 2008, the Guizhou People’s Government strengthened the intellectual property work from seven aspects, in order to completely carry out the intellectual property strategy.
I. Promote implementation of Outline of the National Intellectual Property Strategy and Outline of Guizhou Provincial Intellectual Property Strategy
The 2008 Promotion Plan for Outline of Guizhou Provincial Intellectual Property Strategy was made; the evaluation system for intellectual property strategy was established and implemented; and the target responsibility system for each city, prefecture, local government (district) to implement the intellectual property strategy was implemented; Guizhou Provincial Government established cooperation and consultation mechanism with the State Intellectual Property Office and determined the work tasks; and the joint conference system for implementing the Guizhou Provincial intellectual property strategy was established.
II. Strengthen Investigation Focusing on Key field and Industry to Promote the Establishment of Intellectual Property System
The Guizhou Intellectual Property Administration continuously perfected the draft of Regulations of Guizhou on Protecting the Intellectual Property of Traditional Knowledge; The analysis and research were conducted on applicability of indication protection of agricultural and specialty products of Guizhou Province, Proposal Catalogue for Geographical Indication Protection of Agricultural and Specialty Products of Guizhou Province (draft) was proposed, and the Opinions on Strengthening the Geographical Indication Work of Agricultural and Specialty Products and Energetically Promoting the Development of Agricultural and Specialty Products Economy was drafted and submitted to the Guizhou Provincial Government for issuing and implementing; Opinions on Promoting the Intellectual Property Creation and Application in the Science and Technology Innovation was published; and Guide Opinions on Intellectual Property Work of Hi-tech Industry of Guizhou Province and Opinions on Strengthening Intellectual Property Work of the Tourism Industry were established.
III. Strengthen Intellectual Property Protection and Further Consolidate and Standardize the Market Order
Guizhou Intellectual Property Administration organized the special IPR enforcement activities such as “Thunder Storm”, “Sky Net”; the administrations for industry and commerce jointly held the special activity for Olympic symbol promotion and Olympic symbol protection; the copyright administrations carried out the “special activity on governing the illegal pre-installation of computer software”; the Customs enhanced the supervision with protecting the famous brand of Guizhou Province as the law enforcement focus; and the public security organ carried out one-year “No.2 National Wine” special activity of cracking down making and selling counterfeited national wine MOUTAI and other wine products.
IV. Thoroughly Carry out the Intellectual Property Work of Enterprises and Undertakings and Region to Improve the Ability and Level of Applying Intellectual Property System by the Market Entities
The second round of intellectual property pilot demonstration in the enterprises and undertakings of Guizhou was carried out; by fully using the guide role of government fund, key industries were energetically promoted to implement the intellectual property strategy; and Guiyang City and Zunyi City stably carried out the demonstration city building work of national intellectual property and the experimental city work of intellectual property.
V. Thoroughly Carry out the Promotion Training and Human Resource Cultivation to Improve the Intellectual Property Awareness of the Whole Society
Promotion activity for the week of “April 26th” world intellectual property day in an innovative form was carried out; Special column on Guizhou Daily was continued; the “Cultivation Project for Tens of Thousands of Human Resources” was initiated, and the Plan of Intellectual Property Team Construction of Guizhou Province 2008-2015 and Scheme for Implementing the Cultivation Project for Tens of Thousands of Human Resources of Guizhou were establish; Further, the intellectual property training work and 108 intellectual property trainings and lectures were carried out in the whole province.
VI. Strengthen IT Construction of Intellectual Property to Strengthen Public Service Function
The website of Guizhou Intellectual Property Administration was comprehensively revised; the Guizhou Intellectual Property Information Platform integrating “seven countries and two organizations” foreign and Chinese patent database, Chinese patent text database, well-known brand, famous brand, geographical indication, new plant variety, etc. was established; and the 2nd Patent Technology Exhibition Trade Week in Guizhou was organized to be developed.
VII. Fully Exert the Guide and Support Effect of Special Intellectual Property Fund to Promote the Intellectual Property Creation and Implementation of Guizhou
As to the provincial level special fund for supporting the intellectual property application, 1,345 pieces were involved with the fund amount of RMB 1,876,200, including 1,301 patents, 44 new plant varieties, and 3 geographical indications. Seven cities, prefectures and regions had established the special fund for supporting the patent application under their jurisdiction.
Throughout the whole year, remarkable achievements had been scored in IPR creation and protection in the Province.
The intellectual property creation and protection conditions of Guizhou in 2008 were as follows:
Patent: 2,943 patents were applied, with a year-on-year increase of 6.7%; 1,728 patents were granted, maintaining the same level as that of the previous year. Among the patent applications, there were 873 invention patents, maintaining the same level as that of the previous year; 1,403 utility model patents, with a year-on-year increase of 9.1%; 1,783 service inventions, with a year-on-year increase of 16.1%.
Trademark: 3,278 trademarks were applied, and 1590 were registered, with a year-on-year increase of 10%, among which there were 714 trademarks for agricultural products, realizing a year-on-year increase of 12.3%. Six China well-known trademarks were newly increased. The authentication for 2008 Famous Brand of Guizhou was carried out, wherein 103 brands obtained the title of “Famous Brand of Guizhou”.
Copyright: Totally 67 copyrights were registered in 2008, with a year-on-year increase of 76%.
Other Intellectual Properties: Totally 26 new varieties were applied for new plant variety protection, among which 8 were authorized. Dafang rhizoma gastrodiae, Dingtan pepper, Lianhuan fructus amomi and Yuping Bamboo Flutes had obtained the geographical indication certificates.
Cracking down the Criminal Activities for Infringing the Intellectual Property: The Joint Conference System for Criminal Law Enforcement Protection for Intellectual Property of White Wines of Guizhou Such as MOUTAI and Other National Wines was established, the “Intellectual Property Database for Key Contact Enterprises” and “Database for Criminal Suspects of Infringing the Intellectual Property” were established, and the Cooperation Mechanism for Police and Enterprises to Protect the Intellectual Property by the Public Security Organ of Guizhou Province (Provisional) was formulated. In addition,“No.2 National Wine” special activity was carried out, and totally 13,000 bottles of counterfeited MOUTAI wine, 10,000 bottles of infringed MOUTAI, more than 6,000 counterfeited and infringed packages including brands, and the relevant production tools were destroyed, etc.
Judicial Protection for Intellectual Property: The court systems of Guizhou totally accepted 157 IPR cases at first instance, and settled 139 cases.
