2008年，重慶市加快推進(jìn)知識(shí)產(chǎn)權(quán)保護(hù)模范城市創(chuàng)建，著力營造安全放心的知識(shí)產(chǎn)權(quán)軟環(huán)境，大力提升知識(shí)產(chǎn)權(quán)創(chuàng)造、運(yùn)用、保護(hù)和管理水平，全市知識(shí)產(chǎn)權(quán)保護(hù)工作取得顯著進(jìn)展。
一、 知識(shí)產(chǎn)權(quán)擁有量大幅增長(zhǎng)
2008年，全市專利申請(qǐng)8324件，同比增長(zhǎng)23.96%，其中發(fā)明專利申請(qǐng)1997件，同比增長(zhǎng)24.73%；專利授權(quán)4820件，其中發(fā)明專利授權(quán)532件，同比增長(zhǎng)50.28%。
2008年，全市核準(zhǔn)注冊(cè)商標(biāo)5607件，同比增長(zhǎng)50.08%。新認(rèn)定重慶市著名商標(biāo)81件，復(fù)審再認(rèn)定95件。全市已擁有中國馳名商標(biāo)23件、重慶市著名商標(biāo)355件。
2008年，全市辦理各類作品著作權(quán)登記1130件，同比增長(zhǎng)2.1%，其中普通作品著作權(quán)登記940件，同比增長(zhǎng)1.3%，計(jì)算機(jī)軟件著作權(quán)登記190件，同比增長(zhǎng)6.1%。
二、 知識(shí)產(chǎn)權(quán)政策日臻完善
2008年7月21日，中共重慶市委通過了《關(guān)于進(jìn)一步擴(kuò)大開放的決定》，提出“實(shí)施知識(shí)產(chǎn)權(quán)戰(zhàn)略，創(chuàng)建知識(shí)產(chǎn)權(quán)保護(hù)模范城市”。《重慶市人民政府關(guān)于創(chuàng)建知識(shí)產(chǎn)權(quán)保護(hù)模范城市的意見》的制定工作也在有序進(jìn)行之中。
重慶市知識(shí)產(chǎn)權(quán)局與重慶市對(duì)外經(jīng)濟(jì)貿(mào)易委員會(huì)共同簽訂了《共創(chuàng)重慶市涉外知識(shí)產(chǎn)權(quán)服務(wù)“綠色通道”備忘錄》；與重慶市人事局共同出臺(tái)了《重慶市專利專業(yè)人員資格考試試行辦法》。
重慶市工商局下發(fā)了《關(guān)于深入開展“品牌建設(shè)年”工作的通知》。
三、知識(shí)產(chǎn)權(quán)行政保護(hù)力度不斷加大
2008年，重慶市知識(shí)產(chǎn)權(quán)局與40個(gè)區(qū)縣（自治縣）簽署了《重慶市專利行政執(zhí)法委托協(xié)議書》，區(qū)縣（自治縣）首次擁有了專利行政執(zhí)法權(quán)。2008年，西部十二省區(qū)市在重慶共同簽署《西部十二省市區(qū)專利行政執(zhí)法協(xié)作協(xié)議》，建立了跨地區(qū)專利行政執(zhí)法新模式。
2008年，全市各級(jí)工商行政管理機(jī)關(guān)共查處各類商標(biāo)違法案件582件，收繳和消除商標(biāo)違法標(biāo)識(shí)36,031件，沒收、銷毀侵權(quán)物品44,213件，罰款583.73萬元，嚴(yán)厲打擊了商標(biāo)假冒侵權(quán)行為。
2008年，重慶市版權(quán)局立案查處侵權(quán)盜版案件86件，結(jié)案86件，罰款11.4萬元，被國家版權(quán)局評(píng)為“全國查處侵權(quán)盜版案件有功集體”一等獎(jiǎng)。
2008年，重慶市文化市場(chǎng)行政執(zhí)法總隊(duì)在執(zhí)法工作中檢查音像經(jīng)營單位637家，查繳各類盜版制品483,993件，有力打擊了盜版制品銷售活動(dòng)，依法維護(hù)了權(quán)利人的合法權(quán)益。
四、 知識(shí)產(chǎn)權(quán)海關(guān)保護(hù)成效顯著
2008年，重慶海關(guān)累計(jì)查處知識(shí)產(chǎn)權(quán)案件8件（均為侵犯商標(biāo)權(quán)案件），截獲一批涉嫌侵權(quán)的摩托車、奧運(yùn)會(huì)吉祥物掛牌、服裝等貨物。
五、 知識(shí)產(chǎn)權(quán)刑事保護(hù)和司法保護(hù)水平不斷提升
2008年，重慶市公安機(jī)關(guān)在打擊侵權(quán)盜版違法活動(dòng)中，共受理侵犯知識(shí)產(chǎn)權(quán)案件11件，立案10件，破案3件，抓獲犯罪嫌疑人6名，涉案金額1316.4萬元，挽回經(jīng)濟(jì)損失67萬元，收繳各類侵權(quán)盜版光碟18.3萬張，會(huì)同有關(guān)部門取締非法印刷窩點(diǎn)11家。
2008年，重慶市各級(jí)人民法院新收的知識(shí)產(chǎn)權(quán)民事案件537件，同比上升54.76％，審結(jié)514件，同比上升57.67%；一審新收案件487件，同比上升60.20％，一審審結(jié)462件，同比上升60.98％；解決訴訟標(biāo)的金額861.42萬元。2008年，重慶市各級(jí)人民法院共審結(jié)涉外、涉港澳臺(tái)知識(shí)產(chǎn)權(quán)案件5件，其中涉外3件，涉港澳臺(tái)2件；受理侵犯知識(shí)產(chǎn)權(quán)犯罪案件5件，審結(jié)5件，判處罪犯9人。
2008年，重慶市高級(jí)人民法院下發(fā)了《重慶市高級(jí)人民法院關(guān)于指定重慶市渝中區(qū)人民法院受理部分知識(shí)產(chǎn)權(quán)民事案件的通知》，規(guī)定渝中區(qū)法院作為基層法院，可以審理發(fā)生在轄區(qū)內(nèi)除專利、植物新品種、集成電路布圖設(shè)計(jì)糾紛案件以外的、爭(zhēng)議金額在人民幣300萬元以下的知識(shí)產(chǎn)權(quán)一審民事糾紛案件，進(jìn)一步加大了知識(shí)產(chǎn)權(quán)司法保護(hù)力度。
Summary of Chongqing’s Intellectual Property Protection in 2008
In 2008, Chongqing accelerated the construction of a model city in intellectual property rights (IPR) protection, creating a safe soft environment of IPR, and attached great importance to promote the innovation, utilization, protection and management of IPR. The IPR work had achieved great progress.
I. Great Increase in Possession of IPR
During 2008, Chongqing filed 8,324 patent applications, with 1,997 invention patent applications, respectively increased by 23.96% and 24.73% year-on-year. The granted patents were 4,820 pieces, including 532 inventions which were increased by 50.28% year-on-year.
In 2008, Chongqing approved 5607 registered trademarks, increased by 50.08% year-on-year. In addition, Chongqing newly approved 81 famous trademarks of Chongqing, and approved 95 pieces in re-examination. In a result, Chongqing has possessed 23 well-known trademarks of China, and 355 famous trademarks of Chongqing.
Moreover, 1,130 pieces of works registered copyrights in Chongqing, increased by 2.1% year-on-year this year. Among these, the general copyrights have taken a number of 940 and the ones of computer software were 190, respectively increased by 1.3% and 6.1% year-on-year.
II. Improvement on the IPR Polices
On 21th July 2008, Chongqing Municipal Committee passed the Decision of Expending the Opening up, announced to practise IPR strategy and build a model city in IPR protection. The preparation of Opinions on Constructing Chongqing as a Model IPR City of Chongqing Municipal Government was proceeding steadily.
Together with Chongqing Foreign Trade and & Economic Relations Commission, Chongqing IPR Office signed the Memo of Co-construction for Green Channel of Foreign IPR Services. Moreover, the Chongqing IPR Office and Chongqing Personnel Bureau signed the Rules for Qualification Examination of Patent practitioners in Chongqing (for trial implementation).
Chongqing Administration of Commerce and Industry issued the Notice of Developing the Brand Building Year.
III. Intensified the Administrative Protection of IPR
In 2008, 40 subordinate districts of Chongqing signed the Letter of Authorization of Patent Administrative Law Enforcement, and gained the rights of patent administrative law enforcement for the first time. The western 12 provinces and municipalities of China signed the Collaboration Agreement on Patent Administrative Law Enforcement in Chongqing this year, established a new model of cross-regions patent administrative law enforcement.
In 2008, the administration departments of commerce and industry investigated 582 cases of violation of trademarks, took over 36,031 illegal marks, confiscated and demolished 44,213 pieces of products involving in infringement, and gave punishments of RMB 5,837,300, cracking down on the counterfeit of trademarks.
In 2008, Chongqing Bureau of Copyright investigated 86 cases of piracy, and settled them. The bureau gave punishments of RMB 114,000, and was awarded a first prize for Collectivity of National Investigating and Dealing with Piracy by National Copyright Administration.
In 2008, the Chongqing General Brigade of Cultural Market Administration Law Enforcement inspected 637 stores selling video products, seized 483993 pieces of pirate products, and achieved great success in struggling against sale of pirate products and maintaining legal rights.
IV. Great Achievement in Customs Protection of IPR
In 2008, Chongqing Customs investigated 8 IPR cases (of trademark infringement), detained a passel of products involving in infringement, including motorcycles, mascot cards of Olympic Games, and clothes.
V. Constant Advances in Criminal and Judicial Protection
In 2008, in the campaign against piracy, the public security departments of Chongqing received 11 cases of IPR infringement with 10 filed and 3 cleared up, arrested six suspects, retrieving economic losses of RMB 670,000. These cases involved money of RMB 13,164,000. The departments also confiscated 183,000 pieces of CD, and demolished 11 plants engaging in illegal printing.
In 2008, for civil IPR cases, the courts of Chongqing newly received 537 ones for first instance, second instance and retrial, and settled 514 ones, respectively increased by 54.76% and 57.67% year-on-year. For first instance, the courts received 487 cases and settled 462 cases, respectively increased by 60.20% and 60.98% year-on-year.The courts also settled three foreign IPR cases, and other two cases involving Hongkong, Macao and Taiwan. For criminal IPR cases, the courts accepted five ones and settled completely, condemning 9 criminals.
In 2008, Chongqing Higher People’s Court issued the Notice of Designating People’s Court of Yuzhong District to Accept Part of the IPR Civil Cases. The notice authorized People’s Court of Yuzhong District the rights for trial of cases except those of patent, new variety of plants, layout designs of integrated circuits and with the sum of money less than RMB 3 millions in disputes. The judicial protection on IPR was strengthened greatly.
