2008年，湖南省知識產權事業發展成效顯著，為湖南自主創新和經濟社會發展做出了積極貢獻。
一、知識產權保護環境進一步優化
省委、省政府高度重視知識產權工作。省新型工業化領導小組把企業專利工作納入新型工業化考核指標體系。省人民政府第20次常務會議審議并原則通過了《湖南省知識產權戰略實施綱要》，2009年2月26日由省人民政府正式頒布實施。
知識產權宣傳不斷深入，人才培養工作穩步推進。省人民政府發布了“2007年湖南省知識產權保護狀況”。全省全年共舉辦知識產權培訓班70多期，培訓人員共計15,000人次。湘潭大學成立了知識產權學院。
知識產權協調保護取得新進展。各知識產權相關部門在全省開展知識產權聯合執法及宣傳活動，取得良好成效。截至2008年12月底，湖南省保護知識產權舉報投訴服務中心全年共接受舉報投訴咨詢167 件。
知識產權對湖南經濟的推動作用明顯增強。2008年，全省專利實施數量為7699件，實現銷售收入692.21億元，實現利稅96.71億元，出口創匯17.6億美元。
二、知識產權創造和保護邁上新臺階
（一）專利
2008年，湖南申請專利14,016件，授權6133件，同比增長24.78%、7.84%。其中申請發明專利5335件、授權1196件。全年專利許可合同備案67件。
全省專利行政執法立案163件、結案156件。組織開展了“天網”、“雷雨”專項行動，全省共出動執法人員722人次，檢查商場304次，檢查商品10,320件。
（二）商標
2008年，全省共申請注冊商標10,293件，核準7636件，同比增長24.2%；3件地理標志證明商標被核準注冊；認定湖南省著名商標308件，11件商標被國家工商總局認定為中國馳名商標。
全省各級工商行政管理機關查處各類商標違法案件1429件，收繳和消除商標標識42.03萬件，收繳專門用于商標侵權的模具印版等工具20件，沒收銷毀侵權商品17.57噸。
（三）版權
2008年，全省作品自愿登記252件，計算機軟件版權登記524件，開展涉外版權貿易306項，其中引進外國版權226項，對外輸出版權80項。
全省版權行政部門開展了“打擊非法預裝計算機軟件專項治理行動”和“打擊網絡侵權盜版專項行動”，取得顯著成效。
全省各級文化行政部門全年共出動檢查人員28萬余人次，檢查各類文化市場攤點21.4萬余個，辦結各類案件10,335起，收繳非法音像制品126.5萬余張（盤）。
（四）植物新品種
2008年，全省共有植物新品種授權25個。截至2008年12月，全省累計植物新品種授權82個。
（五）打擊知識產權犯罪
2008年全省公安機關共立侵犯知識產權犯罪案件51起,涉案金額816萬元；破案48起，挽回經濟損失193萬元，抓獲犯罪嫌疑人35名。
（六）知識產權司法保護
2008年，全省法院共受理知識產權一、二審案件584件，結案率達 95%,審判流程信息登陸率100%，裁判文書上網率100%。各級法院知識產權審判部門全年對19件案件進行了7次網絡直播。目前，全省14個市州中級法院已有12個中級法院設立了民三庭，負責知識產權案件的審理。
（七）海關知識產權保護
2008年長沙海關共辦理知識產權案件17起，收繳各類假冒、盜版侵權物品3400余件。
Summary of Hunan Provincial Intellectual Property Protection in 2008
The year of 2008 witnessed rapid progress of intellectual property development in Hunan Province which had contributed much to Hunan’s independent innovation as well as economic and social development.
I. The Further Optimized Environment of IPR Protection
The Provincial Committee of the CPC and the Provincial Government attach much importance to the work of IPR protection. The provincial office of new-model industrialization embodied the work of enterprise patents into the evaluation index system of new-model industrialization. The 20th provincial people's government executive meeting evaluated and approved in principle The Outline of Hunan Provincial Intellectual Property Strategy, and it is to be implemented by the provincial people's government on February 26, 2009.
IPR public education had been continuously deepened, with the work of personnel training being carried out steadily. The Provincial People's Government promulgated the Report on Protection of Intellectual Property Rights of Hunan Province in Year 2007. There were more than 70 training courses of IPR organized across the province throughout the year, and there were 15,000 trainees altogether. At present, Xiangtan University had set up the Intellectual Property Institute.
The coordination of protection of IPR has made new progress. The departments related to IPR in the province carried out joint enforcement actions and public education activities, and achieved fruitful results. By the end of December, 2008, the Provincial IPR Service Centre has altogether received 167 pieces of complaints and inquiries.
The positive impact of intellectual property on the economy of Hunan is obvious. In 2008，the number of patents coming into effect was 7,699, the sales income reached 69.221 billion RMB Yuan, the tax was 9.671 billion RMB Yuan, and the exports value totaled 1.76 billion U.S. Dollars.
II. A Higher Level of Intellectual Property Creation and Protection
1. Patent
In 2008, 14,016 patent applications were filed and 6,133 patents were granted, with an increase of 24.78% and 7.84% respectively compared with previous year. The number of invention patent applications was 5,335, with the number of granted patents as 1,196. In the whole year, 67 patent license contracts were on record.
The patent administration departments at all levels across the province put on record 163 cases in total while 156 cases were concluded. In accordance to the national unified plan, the special actions of "Sky Net" and "Thunder Storm" were organized and 722 law enforcement officers participated in the inspections of 304 shops and 10,320 commodities.
2. Trademark
In 2008, there were 10,293 trademark registration applications, and 7,636 approved ones, with an increase of 24.2% more than last year; 3 geographical indication trademarks were approved; 308 Hunan Famous Brands were identified while 11 Well-known Trademarks in China were identified by the State Administration of Industry and Commerce.
The industrial and commercial administrative organs at all levels altogether investigated and concluded 1,429 Trademark Law related infringement cases, taking over and eliminating trademark signs 420,300 pieces, confiscating 20 pieces of printing template used for trademark infringement, confiscating and destroying infringing goods 17.57 tons.
3. Copyright
In 2008，there were a total of 252 voluntarily registered works and 524 software copyright registrations. 306 foreign-related copyrights trade were carried out, including 226 foreign copyrights imported and 80 copyrights exported.
Copyright administrative departments carried out the special management action of fighting against illegal pre-installed computer software and the fight against internet piracy, and achieved fruitful results.
There were 280,000 inspector-attendances of the province's cultural administrative departments involved in the inspection of 214,000 cultural markets, concluded 10,335 cases, captured over 1,265,000 disks of illegal audio and video products.
4. New Plant Varieties
In 2008, authorized Agricultural New Plant Varieties in Hunan were 25 pieces. By the end of 2008, new agricultural plant varieties authorized had amounted to 82.
5. Combating the IPR Crime
In 2008, the public security departments in Hunan coped with 51 cases of IPR infringement, with total value involved over 8.16 million RMB Yuan, and detected 48 cases, restored economic losses of 1.93 million RMB Yuan, and arrested 35 suspects.
6. IPR Judicial Protection
In 2008, all level courts in Hunan dealt with 584 civil cases about IPR at first and second instances, with the case conclusion rate 95% with all the trial information uploaded on the designated website. IPR Trial courts at all levels heard 19 cases online for seven times. At present, in 14 cities’ intermediate people's courts, 12 had established such mechanism.
7. IPR Customs Protection
2008 statistics showed that Changsha Customs handled 17 IPR cases, 3,400 items of all types of counterfeit and copyright piracy were captured.
