2008年，上海市政府以貫徹落實(shí)國(guó)家知識(shí)產(chǎn)權(quán)戰(zhàn)略為主線，繼續(xù)推進(jìn)實(shí)施《上海知識(shí)產(chǎn)權(quán)戰(zhàn)略綱要》，大力開(kāi)展迎奧運(yùn)保護(hù)知識(shí)產(chǎn)權(quán)專項(xiàng)行動(dòng)，推動(dòng)了上海知識(shí)產(chǎn)權(quán)發(fā)展和保護(hù)工作在新的起點(diǎn)上實(shí)現(xiàn)新的發(fā)展。
一、制定《關(guān)于本市實(shí)施國(guó)家知識(shí)產(chǎn)權(quán)戰(zhàn)略的若干意見(jiàn)》，貫徹落實(shí)國(guó)家知識(shí)產(chǎn)權(quán)戰(zhàn)略
《國(guó)家知識(shí)產(chǎn)權(quán)戰(zhàn)略綱要》頒布后，上海市政府在全國(guó)率先制定了《關(guān)于本市實(shí)施國(guó)家知識(shí)產(chǎn)權(quán)戰(zhàn)略的若干意見(jiàn)》，提出了貫徹實(shí)施國(guó)家知識(shí)產(chǎn)權(quán)戰(zhàn)略、不斷加強(qiáng)上海知識(shí)產(chǎn)權(quán)工作的25條意見(jiàn)。
二、完善政策措施，促進(jìn)知識(shí)產(chǎn)權(quán)數(shù)量和質(zhì)量穩(wěn)步提高
上海市有關(guān)部門(mén)通過(guò)制定、修改、完善政策，鼓勵(lì)企事業(yè)單位自主創(chuàng)新、獲取知識(shí)產(chǎn)權(quán)。盡管受到全球金融危機(jī)的影響，但是上海的知識(shí)產(chǎn)權(quán)數(shù)量和質(zhì)量繼續(xù)保持平穩(wěn)增長(zhǎng)。2008年上海專利申請(qǐng)量達(dá)到52,835件，比2007年增長(zhǎng)11.9% ，其中發(fā)明專利申請(qǐng)量17,829件，增長(zhǎng)17.2%。核準(zhǔn)注冊(cè)商標(biāo)達(dá)到17,420件，增長(zhǎng)64.8%；累計(jì)有效注冊(cè)商標(biāo)總量132,920件，增長(zhǎng)8.5%。辦理作品著作權(quán)登記1565件，著作權(quán)合同備案202份，軟件版權(quán)登記4721件。
三、開(kāi)展專項(xiàng)行動(dòng)，加大知識(shí)產(chǎn)權(quán)保護(hù)力度
2008年上海市有關(guān)部門(mén)開(kāi)展了以“迎奧運(yùn)”為主題的保護(hù)知識(shí)產(chǎn)權(quán)專項(xiàng)行動(dòng)，嚴(yán)厲打擊知識(shí)產(chǎn)權(quán)侵權(quán)違法行為。在奧運(yùn)賽事期間，上海市工商局對(duì)奧運(yùn)比賽場(chǎng)館周邊等重點(diǎn)場(chǎng)所開(kāi)展了專項(xiàng)整治；上海市版權(quán)局建立了處理非法轉(zhuǎn)播奧運(yùn)賽事案件的快速反應(yīng)機(jī)制，安排專人24小時(shí)值班，加強(qiáng)對(duì)全市互聯(lián)網(wǎng)和移動(dòng)通信平臺(tái)的監(jiān)控和管理。2008年，上海市公安部門(mén)共查破各類侵犯知識(shí)產(chǎn)權(quán)違法犯罪案件1458起，打擊處理違法犯罪嫌疑人1708人，追繳贓款贓物價(jià)值共計(jì)人民幣4.48億余元；上海各級(jí)法院進(jìn)一步健全審判機(jī)構(gòu)和完善審判體制，加強(qiáng)知識(shí)產(chǎn)權(quán)司法保護(hù)，當(dāng)年受理一、二審知識(shí)產(chǎn)權(quán)民事案件1757件，審結(jié)1634件，比2007年分別上升43.1％、33.2％。上海在保護(hù)知識(shí)產(chǎn)權(quán)方面的不懈努力得到了有關(guān)方面的肯定。美國(guó)貿(mào)易代表辦公室發(fā)布的《2008年度特別301報(bào)告》指出，“上海市被產(chǎn)業(yè)界觀察家稱贊為中國(guó)知識(shí)產(chǎn)權(quán)保護(hù)環(huán)境中的相對(duì)亮點(diǎn)”。
四、組織形式多樣的宣傳活動(dòng)，營(yíng)造知識(shí)產(chǎn)權(quán)文化環(huán)境
為進(jìn)一步普及知識(shí)產(chǎn)權(quán)知識(shí)，營(yíng)造良好的知識(shí)產(chǎn)權(quán)文化環(huán)境，上海市有關(guān)部門(mén)在“保護(hù)知識(shí)產(chǎn)權(quán)宣傳周”期間，以迎奧運(yùn)、迎世博為主題，組織開(kāi)展了形式多樣的宣傳活動(dòng)，舉辦了上海知識(shí)產(chǎn)權(quán)保護(hù)狀況通報(bào)會(huì)，公布了上海2007年度保護(hù)知識(shí)產(chǎn)權(quán)十大典型案例和十大新聞事件，通過(guò)多種渠道發(fā)布知識(shí)產(chǎn)權(quán)公益廣告，開(kāi)展“世博知識(shí)產(chǎn)權(quán)保護(hù)社區(qū)行”培訓(xùn)活動(dòng)，播放由國(guó)際影星成龍出演的海關(guān)知識(shí)產(chǎn)權(quán)保護(hù)宣傳廣告片，組織知識(shí)產(chǎn)權(quán)案件公開(kāi)庭審，并通過(guò)各大媒體報(bào)道知識(shí)產(chǎn)權(quán)典型案例。
五、舉辦多層次的培訓(xùn)工作，培養(yǎng)各類知識(shí)產(chǎn)權(quán)人才
上海市有關(guān)部門(mén)十分注重知識(shí)產(chǎn)權(quán)人才的培養(yǎng)工作。2008年對(duì)20000余名企事業(yè)單位專業(yè)技術(shù)人員進(jìn)行了知識(shí)產(chǎn)權(quán)公需科目培訓(xùn)；開(kāi)展了專利工作者、高級(jí)專利情報(bào)分析員、軟件資產(chǎn)管理等培訓(xùn)活動(dòng)，有409人經(jīng)考試合格獲得了專利管理工程師證書(shū)。
Summary of Heilongjiang Provincial Intellectual Property Protection in 2008
In 2008, with the wise leadership of provincial Party Committee and government, remarkable results were achieved in IPR business, and self-driven creations and innovations and development of economy and society were robustly promoted, thus contributing to progress of the harmonized society.
I. Take New Steps on IPR Work
In August, 2008, the formulation work of the Outline of Heilongjiang Provincial IPR Strategy was officially started. In October, the cooperation mechanism between State Intellectual Property Office (SIPO) and Heilongjiang Provincial Government was officially established. During the period of Consumers’ Day on March 15th and World IPR Day on April 26th, Provincial Intellectual Property Administration （IPA）utilized news media, publicized IPR, distributed more than 100,000 copies of IPR materials to the public. In 2008, IPR international communication and cooperation channels were broadened. Sino-US Seminar on Intellectual Property Protection and Enforcement Strategies was held. With the multi-purpose, all-directional, high quality and high effective IPR service to the entire society as the objective, Provincial IPA further strengthened the IPR international website construction, the patent database data were expanded to 23 million.
II. Steadily Promote Patent Protection Work
In 2008, the patent application amount of our province reached to 8,351, increased by 15.3% over that of last year. By the end of 2008, the accumulated patent applications of the province were 77,263, and the granted were 41,993. In 2008, focus was given to five key professions and the prop enterprises of equipment, energy, petro-chemical, medicine and food in Heilongjiang Province. Optimum projects were selected, key breakthrough was made, and the patented technologies industrialization was advanced. IPR system of the whole province strengthened the patent executive enforcement, carried out the routine inspection and the centralism reorganization, promoted the formation of the IPR legal system environment.
III. Strengthen the Trademark Protection
The trademark supervision work was fully advanced. The on-site investigation to 27 enterprises which applied the well-known trademarks and reexamination of provincial famous trademarks were carried out. In 2008, 278 provincial famous trademarks were identified, 9 provincial well-known trademarks were newly identified. The number of the valid trademarks reached to 29. More than 2,000 agricultural products trademarks were registered and 26 Geographical Indication applications were filed.
IV. Constant Development of the Copyright Protection
124 network infringement cases were severely attacked; more than 20,000 pirated audio-video products and computer softwares were confiscated. 13 municipal (area) culture administrative departments of the entire province carried out the illegal audio-video products coordinate destruction action, and altogether destroyed nearly 500,000 pieces of illegal audio-video products. The publicity activity for 17th anniversary of Copyright Law implementation and evaluation activity for Legal copy product management demonstration unit were carried out. The enterprises’ using the legal copy software work was advanced effectively.
V. Protection for New Plant Varieties was Further Strengthened
Provincial Agricultural Committee organized the related divisions (stations) to carry out the market inspection on the granted varieties sales situation, and investigated 12 counterfeit and infringement cases. In August, 2008, they held new plant variety protection on-site meeting at Qing Gang County, invited the experts from new plant variety protection test center of Province Institute of Agricultural Sciences to explain the related knowledge on the application, examination and so on of new plant variety protection.
VI. The Customs Protection for IPR were Further Strengthened
In 2008, Harbin Customs organized several well-known brand owners to carry out the distinction training activity in various ports customs, effectively improved the IPR law enforcement ability of the executive officers. In 2008, 59 cases were discovered and seized, of which the value was 1,846,800 RMB.
VII. Public Security Authority Further Strengthening the Investigation and Handling of the IPR Cases
In 2008, 31 cases were placed on file for investigation and prosecution by the public security authorities of the entire province, 9 cases were solved, 37 suspects were caught, of which the value was more than 16,047,600 RMB. Meanwhile, they established the cooperation mechanism with the procuratorate, court, and the horizontal administrative law enforcement departments. They strengthened the cooperation mechanism of attacking transnational economic crimes with Russian Police, reached the agreement on cooperative investigation and detection motion on the transnational economic crimes cases.
VIII. Procuratorial Organ Thoroughly Carrying Out the Special Action of IPR Infringement Crime’s Putting on Record Supervision, IPR Judicature Trial Ability Further Enhanced
In 2008, all levels of the procuratorial organs of the entire province seriously implemented the decision and deployment of The Supreme People’s Procuratorate (SPP) about carrying out the special action of IPR infringement crimes’ putting on record, positively explored the effective way in special action, strengthened the supervision. All levels of the procuratorial organs of the entire province established the leading group took general prosecutor as the group leader, deputy prosecutor in charge of the work as the vice-group leader, personnel from the investigation and supervision department as the members, carried on the inspection to the progress situation of the special action, and gave the face-to-face instruction to the questions existed. In 2008, Provincial Superior Court distributed Notice on Severe Judicature Identification of the Well-known Trademark to each intermediate court, offered classic cases for reference, and unified the law enforcement standard. The courts of the entire province altogether heard 352 cases of IPR dispute, effectively safeguarded the IPR owners’ legal rights and interests.
