2008年，在市委、市政府的高度重視下，北京市知識(shí)產(chǎn)權(quán)工作緊緊圍繞“新北京、新奧運(yùn)”的戰(zhàn)略構(gòu)想，貫徹《國(guó)家知識(shí)產(chǎn)權(quán)戰(zhàn)略綱要》精神，以服務(wù)首都經(jīng)濟(jì)社會(huì)發(fā)展為中心任務(wù)，大力實(shí)施首都知識(shí)產(chǎn)權(quán)“一二六”工程，不斷推動(dòng)首都知識(shí)產(chǎn)權(quán)事業(yè)發(fā)展，進(jìn)一步鞏固了北京市知識(shí)產(chǎn)權(quán)強(qiáng)市地位。
一、集中開(kāi)展保護(hù)奧運(yùn)知識(shí)產(chǎn)權(quán)專項(xiàng)行動(dòng)，有效發(fā)揮了外圍保障作用
在全市范圍組織開(kāi)展了保護(hù)奧運(yùn)知識(shí)產(chǎn)權(quán)專項(xiàng)行動(dòng)，市政府主管領(lǐng)導(dǎo)親自動(dòng)員部署，各部門(mén)按照“提高思想認(rèn)識(shí)、落實(shí)部門(mén)責(zé)任、強(qiáng)化協(xié)調(diào)機(jī)制、展示首都形象”的工作原則，迅速開(kāi)展整治行動(dòng)，有效發(fā)揮了外圍保障作用。國(guó)際奧委會(huì)法律部主任霍華德•斯圖普先生和國(guó)際奧委會(huì)北京奧運(yùn)會(huì)協(xié)調(diào)委員會(huì)主席維爾布魯根先生都給予了高度的評(píng)價(jià)。
二、加強(qiáng)對(duì)流通領(lǐng)域的監(jiān)管，進(jìn)一步鞏固了知識(shí)產(chǎn)權(quán)保護(hù)防御體系
針對(duì)侵犯知識(shí)產(chǎn)權(quán)行為主要集中在銷售環(huán)節(jié)的現(xiàn)象，各部門(mén)繼續(xù)深化“無(wú)冒充專利示范單位”、 “無(wú)假冒商標(biāo)示范單位”、“正版產(chǎn)品銷售示范單位”等示范工作，進(jìn)一步加大對(duì)商場(chǎng)、市場(chǎng)、商店、展會(huì)等流通領(lǐng)域的監(jiān)管力度，防范侵權(quán)行為的發(fā)生，有效減少了侵權(quán)商品制售的渠道，進(jìn)一步鞏固了知識(shí)產(chǎn)權(quán)保護(hù)的防御體系，取得了顯著成效。
三、加大知識(shí)產(chǎn)權(quán)宣傳教育力度，進(jìn)一步提高了知識(shí)產(chǎn)權(quán)保護(hù)意識(shí)
結(jié)合“3.15”國(guó)際消費(fèi)者權(quán)益日、“4.26”世界知識(shí)產(chǎn)權(quán)日、“12.4”全國(guó)法制宣傳日以及北京奧運(yùn)會(huì)召開(kāi)等，開(kāi)展了“2008年中關(guān)村知識(shí)產(chǎn)權(quán)論壇”、“中國(guó)企業(yè)在歐洲的知識(shí)產(chǎn)權(quán)保護(hù)問(wèn)題專題講座”、“奧運(yùn)版權(quán)保護(hù)論壇”、“創(chuàng)新與未來(lái)--青少年版權(quán)保護(hù)主題教育活動(dòng)啟動(dòng)儀式”、“2008中國(guó)(北京)國(guó)際版權(quán)論壇”等一系列宣傳活動(dòng)，進(jìn)一步提高了全社會(huì)保護(hù)知識(shí)產(chǎn)權(quán)的意識(shí)。
四、知識(shí)產(chǎn)權(quán)行政執(zhí)法和司法保護(hù)力度進(jìn)一步加大
專利管理部門(mén)共受理專利糾紛案件38件，審結(jié)34件；共立案查處假冒他人專利行為案件3件、冒充專利行為案件8件，結(jié)案2件。
商標(biāo)監(jiān)管部門(mén)共查處商標(biāo)侵權(quán)假冒案件2292件，罰沒(méi)款2650萬(wàn)元。其中查處侵犯奧標(biāo)案件644件，罰沒(méi)款752萬(wàn)余元。
質(zhì)量技術(shù)監(jiān)督部門(mén)共結(jié)案涉及知識(shí)產(chǎn)權(quán)制假違法案件1698件,罰沒(méi)款執(zhí)行到位898.8萬(wàn)元。
文化市場(chǎng)管理部門(mén)共立案處罰侵犯著作權(quán)案件715件，收繳非法音像制品186萬(wàn)余張、非法出版物146萬(wàn)余冊(cè)。
城管執(zhí)法機(jī)關(guān)累計(jì)查繳非法圖書(shū)1855冊(cè)，查繳非法音像制品119,083張、電腦軟件7944余張。
公安機(jī)關(guān)共查辦非法出版物、盜版等案件823件，抓獲違法犯罪嫌疑人1620人（刑事拘留339人，行政拘留1211人），收繳各類非法出版物151.1萬(wàn)張（冊(cè)）。
北京海關(guān)共計(jì)查獲侵權(quán)貨物1562批次，侵權(quán)貨物數(shù)量76,489件。其中查獲侵犯奧林匹克標(biāo)志專有權(quán)商品11批次，侵犯奧標(biāo)商品1489件。
檢察機(jī)關(guān)經(jīng)審查批準(zhǔn)逮捕侵犯知識(shí)產(chǎn)權(quán)類案件71件136人，經(jīng)審查提起公訴83件144人。
全市法院知識(shí)產(chǎn)權(quán)庭共受理各類一審知識(shí)產(chǎn)權(quán)案件4748件，審結(jié)4499件；受理各類二審知識(shí)產(chǎn)權(quán)案件1768件，審結(jié)1744件。
2008年，在我市各知識(shí)產(chǎn)權(quán)部門(mén)的共同努力下，知識(shí)產(chǎn)權(quán)保護(hù)取得了顯著成效，進(jìn)一步優(yōu)化了首都社會(huì)經(jīng)濟(jì)發(fā)展環(huán)境。
Summary of Beijing’s Intellectual Property Protection in 2008
In 2008, with the municipal Party committee and municipal government of Beijing attaching great importance to IPR protection, local IPR protection efforts in Beijing closely followed the strategic idea of “New Beijing Great Olympics”, carried forward the spirit of the Outline of the National Intellectual Property Strategy, in a bid to serve the economic and social development of Beijing, the capital of China. The municipality has been working to carry out the “One Two Six” Campaign of IPR, promoted the continuous development of IPR cause and further boosted the status of Beijing as a national leader in IPR.
I. Olympics-specific IPR Campaign Served as a Shield for the Olympic Games
The Olympics-specific IPR campaign was quickly carried out citywide, and thanks to the personal arrangement by competent leaders of the Municipality and the working principles observed by each department (these principles are: Raise Awareness, Put in Place Department Responsibilities, Reinforce Coordination Mechanism and Showcase the Image of Beijing), served as shield for the Olympics. Mr. Howard Stupp, IOC's Director of Legal Affairs, and Mr. Hein Verbruggen, chairman of the IOC-BOCOG coordination committee, both highly applauded the campaign.
II. Tightened Regulation on Circulation Sectors and Further Consolidated the Defense System of IRP Protection
Given that IPR infringements mainly occur in the sales distribution process, all departments remained committed to the advocacy of role models such as Non-Counterfeit Patent Model Unit, Non-Counterfeit Trademark Model Unit and Original Product Sales Model Unit and stepped up regulation on such circulation sectors as supermarkets, markets, shops and exhibitions to prevent IPR infringements. Good results were achieved as channels for manufacturing and selling infringing goods were curtailed and the defensive system of IPR protection was further consolidated.
III. Intensified IPR Advocacy and Education and Further Raised the Awareness of IPR Protection
In tandem with occasions such as the World Consumer Rights Day on March 15th, World Intellectual Property Rights Day on April 26th, National Legal System Publicity Day on December 4th and the holding of Beijing Olympic Games, the municipality organized Zhongguancun Intellectual Property Rights Forum 2008, Lecture on the Protection of Chinese Enterprises’ Intellectual Property Rights in Europe, Olympic Copyright Protection Forum, Innovation and Future-Launching Ceremony of Youth Intellectual Property Rights Protection Education Campaigns and Beijing International Copyright Forum 2008. All these campaigns further improved the public’s awareness of IPR protection.
IV. Administrative Law Enforcement and Judicial Protection of IPR in 2008
The patent administration handled 38 patent dispute cases with 34 concluded, brought 3 cases of fake patent identity and handled 8 counterfeit patent cases with 2 concluded.
The trademark administration handled 2,292 cases of trademark counterfeiting and imposed RMB26.50 million yuan in fines. Among the cases, 644 involved infringements of Olympic symbols and resulted in RMB7.52 million yuan of fines.
The Quality Supervision and Inspection Bureau handled 1,698 of cases of intellectual property rights counterfeiting, and imposed RMB8, 988,000 yuan in fines.
Cultural market administration filed and fined 715 cases of copyright infringements, seized over 1.86 million illegal AV products, over 1.46 million illegal publications.
The City Administration Authority seized 1,855 illegal books, 119,083 illegal AV products and up to 7,944 pieces of pirated computer software.
The police uncovered 823 cases relating to illegal publications or piracy, placed 1,620 criminal suspects into custody (339 into criminal custody and 1,211 into administrative custody) and seized 1,511,000 illegal publications.
The Beijing Customs seized 1,562 shipments of infringing goods, totalling 76,489 pieces. Of those goods, 11 shipments of 1489 items were counterfeit Olympic commodities.
Prosecution authorities citywide approved apprehension of 136 suspects in 71 cases related to intellectual property right, and prosecuted 83 cases involving 144 suspects.
The IPR division of city-level courts investigated 4,748 IPR cases of first instance and concluded 4,499; investigated 1,768 IPR disputes of second instance and concluded 1,744.
In 2008, prominent results for the protection of intellectual property rights in Beijing were achieved, and the environment for economic and social development in Beijing, the capital of China, was further optimized.
